LIMITED WARRANTY Manufacturer warrants to the original retail customer only, that this product is free from defects in material or workmanship for a period of 90 days. If Customer discovers within this period a failure of the Products to conform to specifications or a defect in material or workmanship, it must promptly notify Company in writing. A receipt or other proof of the original purchase date is required in order for the Customer to be eligible for warranty replacement. Manufacturer's sole responsibility under any warranty claim shall be the replacement of the defective product. These remedies are the Customer's exclusive remedies for breach of warranty. Manufacturer does not warrant (a) defects caused by failure to operate the product in a suitable operating environment, (b) damage due to use of the product for purposes or with equipment other than those for which it was designed, (c) damage caused by disasters such as fire, flood, wind, rain and lightning, (d) damage cause by unauthorized attachments or modification, (e) damage during shipment, (f) normal wear and tear or cosmetic damage to the product, (g) damage due to improper maintenance, (h) any other abuse, misuse, neglect, mishandling, alteration, or faulty installation by the purchaser. Manufacturer reserves the right to determine if a particular product failure is the result of Company's products or services, or caused by some other event. THE FOREGOING WARRANTIES ARE IN LIEU OF ALL OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. In no case shall Manufacturer be liable for any special, incidental, or consequential damages based upon breach of warranty, breach of contract, negligence, strict tort or any other legal theory. Such damages include but are not limited to loss of profits, loss of savings or revenue, loss of use of the product or any associated equipment, cost of capital, cost of any substitute equipment, facilities or services, downtime, the claims of third parties including customers, or injury to property. Customer's use of this product constitutes affirmative acceptance of the above terms and conditions.
